1. Acceptance of Terms

By accessing or using the Restora Health website (restorahealth.net) or any services offered by Restora Health LLC ("Restora Health," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and Restora Health LLC, a Florida limited liability company. We reserve the right to modify these Terms at any time. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.

2. Medical Disclaimer

The content on this website is provided for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Nothing on this website should be construed as creating a physician-patient relationship. A physician-patient relationship is established only after Dr. Kresch has conducted a clinical evaluation, reviewed your medical history, and agreed to provide ongoing care.

Do not rely on information on this website to make medical decisions. Always consult a qualified healthcare professional for advice tailored to your specific medical situation. If you have a medical emergency, call 911 or go immediately to your nearest emergency room.

3. Telehealth Services

Restora Health provides telehealth medical services to patients located in the state of Florida or the state of New York at the time of the consultation. You must be physically present in Florida or New York at the time of each telehealth visit. If you are located in a different state at the time of your appointment, the consultation may not proceed.

Telehealth services are not appropriate for medical emergencies. If you are experiencing a medical emergency, call 911 immediately. Telehealth is not a substitute for in-person emergency care.

By scheduling a telehealth visit, you consent to the delivery of medical services via videoconference technology. Telehealth visits are subject to the same professional and ethical standards as in-person visits.

4. Payment Terms

Consultation Fee: The initial physician consultation fee is $150. This fee is due at the time of booking. The consultation fee is non-refundable once the visit has occurred. If you need to cancel or reschedule, please do so at least 24 hours before your scheduled appointment to avoid forfeiture of the fee.

Monthly Membership: If you enroll in the Restora Health membership program, the fee is $299 per month, billed monthly. Your membership is month-to-month with no long-term contract. You may cancel at any time by notifying us through your Cerbo portal or by emailing info@restorahealth.net before your next billing date. There are no cancellation fees or penalties.

Application of Consultation Fee: If you join the membership program following your initial consultation, the $150 consultation fee will be applied as a credit toward your first month's membership, reducing your first month to $149.

HSA/FSA Eligibility: Consultation and membership fees are eligible for payment with Health Savings Account (HSA) or Flexible Spending Account (FSA) funds. Restora Health is not responsible for determining your individual HSA/FSA eligibility — consult your plan administrator.

Medication costs are not included in the membership fee and are obtained separately through your pharmacy, with or without insurance coverage.

5. Privacy

Your use of our website and services is subject to our Privacy Policy and HIPAA Notice of Privacy Practices, each of which is incorporated by reference into these Terms. Please review those documents carefully.

6. Intellectual Property

All content on this website — including text, graphics, logos, images, and the compilation thereof — is the property of Restora Health LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from this website without prior written permission from Restora Health LLC.

The Restora Health name, logo, and tagline "Metabolic Medicine" as used in connection with Restora Health LLC are proprietary to Restora Health LLC.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Restora Health LLC, its officers, directors, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the total amount you have paid to Restora Health LLC in the twelve (12) months preceding the claim.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded or limited under applicable law, including liability for medical malpractice where required by law.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Miami-Dade County, Florida.
